    Structured advice on client vehicle/s up for sale/trade, how to increase the value, providing necessary information on documents required, structure of photos, as far as to suggestions advertising.

General
The following terms and conditions apply to all three tiers of service.

Please read the following terms and conditions carefully before using services offered by Don’s Advisory Pty Ltd (Don’s Advisory) as the terms are binding between the client and Don’s Advisory.

You must be 18 years old or older to use the services offered by Don’s Advisory. If not, you must obtain parent/legal guardian consent prior to using Don’s Advisory.

If you are an employee of a company or other entity, you must be authorised to use Don’s Advisory on behalf of your employer/entity.

Unless otherwise stated, all services featured on donsadvisory.com.au are only available in Australia. All advertising is intended only for the Australian market. You are responsible for evaluating the suitability of any service throughout the website. Redistribution or republication of any sort from this site or its content is prohibited without the express written consent of the company.

Termination of agreement
Both the client and Don’s Advisory, have the right to terminate any services agreement within reason including the ending of services that are already underway. Refunds shall be offered within the specifications listed under services descriptions:
-Termination of agreement within reason includes abuse toward person/s and/or company, including verbal, written and physical abuse of any kind.

Disclaimer
The information on the donsadvisory.com.au or advice within consultation is offered on an ‘as is’ basis. To the fullest extent offered by law, this company:

– Excluded all representations and warranties relating to this website and advice and its contents which is or may be provided by any affiliates or any other third party, including in relation to any inaccuracies or omissions in this website, and/or the Companies literature, and;
– Excludes all liability for damages arising out of or in connection with your use of this website/advice. This includes without limitation, direct loss, loss of personal or business profits (whether the loss of profits were foreseeable, arose in the normal course of things or you have advised the Company of the possibly of potential loss, damage caused to your computer, computer software, programs and the data thereon or any other direct or indirect, consequential and incidental damages.

Don’s Advisory is not a mechanical workshop nor a mechanic, Don’s Advisory does not and cannot provide any assurances or information on the mechanical integrity of prospective vehicle/s. If any queries to the mechanical integrity of prospective vehicle, the client should consult with their local mechanic.

Expert Advice
(Consultation Only)

Initial 15-minute consultation is complimentary
1 hour consultation after the fact is $89
Every 30 minutes thereafter is $40


$89 consultation fee is paid in FULL at point of booking.
$40 thereafter is paid in FULL at point of further booking

The 1 hour; split into 2 x 30 minute or 3 x 20 minute intervals initially initiated via Zoom video meeting and can be followed by phone call after the fact.
Additional time arrangements can be made; these will incur an additional $40 per hour paid via EFT, or via/credit card with an invoice provided.

Cancellation and penalties It is required that all clients provide at least 24 hours’ notice when cancelling or rebooking an appointment.

If cancellation is less than 12 hours before appointment, the client will be charged for the full consultation and therefore receive no refund.

If the client attends the Zoom conference more than 15 minutes after the consultation start time, this will be considered a ‘no show’ and the client will be charged for the full consultation and therefore receive no refund. If a client provides reasonable express notice of their late attendance, the appointment will be rescheduled by consent.

– If cancellation is less than 24 hours before appointment, $20 will be forfeited by the client and the remaining $69 will be refunded within 72 hours.

– If cancellation is more than 24 hours before appointment, 100% of the consultation amount will be refunded within 72 hours.

Don’s Advisory acknowledges that exceptional circumstances may impact a client’s ability to attend a consultation. Don’s Advisory retains an absolute discretion to alter the application of the above cancellation rules if permitted by the circumstances.

Rescheduling:
Rescheduling of appointment incurs no cost unless the notification occurs less than 3 hours before the consultation. In these circumstances, there will be a rescheduling fee of $10. If a client does not agree to the rescheduling fee, $10 will be forfeited and the remaining balance of $79 will be refunded to the client within 72 hours.  

As with cancellations, Don’s Advisory retains an absolute discretion to alter the application of the above rescheduling rules if permitted by the circumstances.

Buying (Buyers Advocacy)

Please note; an $89 fee will be charge upon acceptance of service to confirm service and for fuel used to visit workshops, car-yards and dealerships.
This fee will not be deducted from the below cost.
E.g. $89 + Investment Cost to be paid within the described criteria below.. 

The initial consultation is based on the 15 minute complimentary session. if more time is needed to discuss the service further, a 1 hour; split into 2 x 30 minute or 3 x 20  minute intervals otherwise a further 30 minute consultation; 2x 15 minutes, 1×30 minute consultations will be initiated via Zoom video meeting or phone call and can be followed by phone call after the fact.
Additional time arrangements can be made; these will incur an additional $50 per hour paid via EFT, or via/credit card with an invoice provided.

The following fees will be charged upon an offer being made to the client of a vehicle on the terms that are agreed between Don’s Advisory and the client.

*The agreed value of the car is the initial advertised cost of the client’s prospective vehicle at the time. If the car is negotiated to a lower price, this will not change the applicable commission bracket. For the avoidance of doubt, the ‘Investment’ amount is based exclusively off the advertised price of the vehicle.

e.g. Client wants a vehicle with the advertised value of $72,000 in the private market; the cost of service will be $550 in addition to the consultation fee of $89 even if the cost is negotiated down and purchased for $67,000 through Don’s Advisory making $550+$89 = $639 for the service 

Payment:
If a client wishes to use the Buyer’s Advocacy of Don’s Advisory, there will first be initial consult of 1 hour which is booked online at donsadvisory.com.au.  The cost of this consult is $89 and payment will be taken at the point of purchase.

The initial 1 hour consult for this service will be split up into 2 x 30 minute or 3 x 20 minute intervals.

If a client confirms following the consultation that they wish to proceed with the Buyer’s Advocacy Service, the client will be charged the following fees if and when Don’s Advisory secures an offer for the vehicle within the defined parameters.

An example is as follows:
..If the client wants a vehicle advertised at $67,000 in the new/demo/dealer used market, the applicable investment fee is $595. 50% of this fee ($297.50) will be collected with the $89 initial fee making $386.50 prior to the Buyer’s Advocacy service being undertaken. This payment will be made via direct transfer to the following details:

If, and when an offer for the vehicle is secured at the agreed price OR the vehicle is delivered to the client, the client will be charged a further fee of $175;

-Once Don’s Advisory has secured the customers prospective vehicle within the parameters originally agreed upon [specifiers included are within reason and within ‘reasonable price’], a document substantiating claim will be sent along with an invoice rendered for completion of service; once paid for all relevant documents and information pertained within Don’s Advisories time held will be handed to customer.
–If the client wishes for Don’s Advisory to carry out paperwork an additional cost of $50 will be charged and reflected upon an updated invoice.

Once service has been carried out and vehicle delivered to client:
The remainder of $175 will be paid to Don’s Advisory Pty Ltd then finalising services with a total of $439 paid to Don’s Advisory Pty Ltd

Inability to find agreed on vehicle:
If Don’s Advisory is unable to acquire any feasible leads or prospects within 72 hours of agreement or any such other reasonable time, the customer will be charged a flat fee of $50 and refunded the remaining of the investment fee within 72 hours. The $50 fee is not a penalty but is reasonable compensation for the time taken to make enquiries regarding the vehicle, contacting dealers, reviewing online sales platforms, attendance at verbal and written conferences and potential travel to isolate prospective vehicle.

-Customer will be provided with all relevant enquiries made by Don’s Advisory for their records.

Cancellation:
If the client cancels the Buyer’s Advocacy service no more than 24 hours after the request is made, the client will be refunded the full investment amount already paid by the client within 72 hours. The consultation fee of $89 will not refunded.

If cancellation is 24 hours or more after consultation; …

If the client cancels the Buyer’s Advocacy service more than 24 hours after the request is made, the client will be refunded 50% of the investment amount already paid by the client within 72 hours. The consultation fee will not be refunded.

Worked example:
–Agreed value of vehicle; $35,000 = $375 investment fee
$187.50 will be paid upfront by the client and the remaining $187.50  will be paid at the time of delivery.

If a customer cancels the service more than 24 hours after the Buyer’s Advocacy service is confirmed, the client will be refunded $93.75 and will forfeit the remaining $93.75 to cover the work already undertaken by Don’s Advisory to secure the prospective vehicle.

Estimated Time of Completion
Expanding variations of vehicles can affect the estimated time of delivery such as availability of stock in regards to colour, variation including differences in engine type, fuel type, factory options, electrification, additional accessories and factory options not limited to interior colour, upholstery type, heated/cooled or perforated seats, rim or tyre changes, and/or asked for upgrades and inclusions; Due to this, if vehicle requested is within stock and approvals are met along the way, ETA of delivery will be 5 business days from date of isolation (customer will be notified once vehicle has been isolated)
This allows time to liaise with client to pertain necessary documentation, and authorities signed within personal or business respects; if client fails to respond to communications ETA will be extended by 1 day at a time.
Don’s Advisory allows 72 hours to isolate client vehicle making in total an estimated 8 business days for isolation, document collection, signing and returning to seller for delivery.
–Don’s Advisory is not responsible for any delays in affect of the selling party; responsibility on Don’s Advisory is solely to communicate why a delay is taking place.

Third Party Services:
At Don’s Advisory, clients may require third party/s to legitimize the purchase of clients new/prospective vehicle. Third party services are independent of Don’s Advisory therefore it is upon the client’s responsibility to contact and make relevant enquiries with third party/s

Delivery of Vehicle
Don’s Advisory is open to organising delivery of vehicle via tow truck or personal driver as an out-of-pocket cost of the customer. Don’s Advisory can deliver the vehicle personally within a 15km radius within the parameters that the return trip is covered by the customer. (getting the driver home via uber or taxi)
Within this agreement the following liabilities will be lifted indemnifying Don’s Advisory:
-Damage incurred from tow truck ; tow truck company will have a privacy policy covering damages; it is upon the customer to follow this up.
-Imperfections/light paint defects incurred by driving vehicle on road to place of residence/delivery; As driving a vehicle on any road will inherit slight damage from rocks or debris, it is likely the incur light paint defect and damages from merely driving a vehicle.

Exclusions:
Mechanical/Structural Failures; Due to the unpredictable nature of used/second-hand vehicles inherited from weather, excessive/lack of use, age, damage, maintenance or lack there-of. Don’s Advisory accepts no responsibility for vehicles after purchase.

  • Don’s Advisory is not a mechanical workshop nor a mechanic, Don’s Advisory cannot consult on the mechanical integrity of prospective vehicle/s. If any queries to the mechanical integrity of prospective vehicle, the client should consult with local/trusted mechanic.

Warranty/Guarantees:
The following must be understood by any client wishing to Don’s Advisory Buying Service.

Don’s Advisory Pty Ltd does not offer warranty or guarantees on prospective vehicles.

All licensed car dealers have a ‘cooling off period’ most will allow the minimum amount of 3 clear business days (excluding weekends and public holidays) after signing a contract if you have a change of mind. Other dealers may extend this period, it is upon the business’ discretion.
All licensed car dealers must also sell all used vehicles with a statutory warranty under section 54 of Victoria’s Motor Car Traders Act 1986, which provides that, subject to certain provisions, when a person buys a second-hand vehicle from a dealer that was manufactured not more than 10 years before the date it was sold and has been driven for less than 160 000 kms, that person has a particular statutory warranty that defects will be repaired or otherwise made good.
A statutory warranty lasts 3 months or 5000kms from date of purchase.
A statutory warranty excludes any cover on motorcycles, commercial vehicles and vehicles sold at a public auction

*In the event of any concern of the vehicle, It is not up to Don’s Advisory to rectify dispute; it is upon the customer to initiate and rectify the situation as the owner vehicle. Don’s Advisory can only advise within these situations.

Vehicles that are sold within the private market do not come with any form of warranty or guarantee whatsoever.
It is upon the prospective purchaser to ensure all relevant checks have been undertaken. E.g.
– service history (full or partial)
– checked for mechanical integrity (*optional)
– checked for structural integrity (*optional)
-Vehicle sold with a valid Roadworthy Certificate (*if registered upon transfer)
-Vehicle has had a PPSR check (if vehicle is currently encumbered, has been stolen/written off (PPSR – Quick motor vehicle search)

Vehicle specifiers
The customer recognises the wide variety of vehicles, vehicle options and variations and acknowledges the likelihood of locating vehicle/s ‘within reason’ also falling under a ‘reasonable price’.

‘Within reason; due to such wide variety of vehicles dependent on colour, kilometres, year model and options (factory or aftermarket); …

‘Reasonable price’; Due to the wide variation of prices on the same type of vehicle in the market, Don’s Advisory requires a reason price to isolate [to be discussed during consultation as is subjective to each client]
Please note, prices advertised are NOT prices vehicles are sold for as all vehicles are subject to negotiation before sale; …

– Kilometres: within 5000 kilometres
– Year model: within 3 years or newer; dependent on how strict the client is on year model
– Colour; due to popularity of certain vehicles within certain brands e.g. Rally Blue; Subaru which increases value and difficulty to locate, Don’s Advisory will require 2-3 options of colour

Sale/Trade (Sales Advice)
If a client wishes to use the Sales Advice service of Don’s Advisory, a consultation will be first booked on the website.
The initial consultation is 1 hour; split into 2 x 30 minute or 3 x 20 minute intervals initially initiated via Zoom video meeting and can be followed by phone call after the fact.
Additional time arrangements can be made; these will incur an additional $50 per hour paid via EFT, or via/credit card with an invoice provided.

If following the consultation, the client confirms they wish to proceed with a Sales Advice tier 1 or tier 2 service, a further $250 fee will be charged. An invoice will be rendered and sent to the client and Don’s Advisory will commence services once this is paid and evidence to same is provided. 

Sale/Trade is offered under two tiers.

  1. Documents: Providing specifications, features, market research pricing breakdowns, pre-written ad bio, tailored advice, key information to know and explanations making interacting with prospective buyers easy and seamless.

  1. -‘Selling on behalf of
    Ensuring; vehicle value is optimal, Tailored advice to circumstances, Referrals to service if required, Buyer Screening; we talk to the client and handle all the negotiation, Liaising; Don’s Advisory will liaise with seller for test drives and Paperwork; all paperwork ready to go for handover.

*’Selling on behalf of’, is offered on a case by case basis; within reasonable distance and vehicle condition.

Reasonable distance: Within 15kms of Metropolitan Melbourne

The fees are as follows:

Tier 1; $250.
50% deposit will be required at the point of purchase with the remaining $50 and time of handover

–Worked example:

$175 will be deposited at time of booking
The remaining $175 will be deposited at time of handover.

Tier 2; $400
50% deposit will be required at the point of purchase with the remaining 50% and time of handover

–Worked example:

$200 will be deposited at time of booking
The remaining $200 will be deposited once seller has completed vehicle transfer and sale documents.

Variations to Tier 2;
Interstate sale ;
If the vehicle is sold to a buyer interstate, the following will need to be done:

1. Victorian registration cancelled ;  this can be done online via the MyVicRoads portal (client must register for an account portal —https://www.vicroads.vic.gov.au/online-services/login)
-Client can also call VicRoads via 13 11 72 or visit a VicRoads customer service building

–Depending on the registration remaining, you may be able to claim a refund for registration. This amount will be refunded to vehicle buyer IF the full vehicle sale amount (after negotiations) was paid as the vehicle sale price included registration value

2. Provide Buyer’s/Sellers receipt that has buyer and seller information, at minimum ; license number and expiry date, first and last name, email address, mobile phone number, residential address, agreed price of purchase, date of purchase, both buyer and seller signatures and date signed) 

3. Vehicle will require a VicRoads unregistered vehicle permit via the following portal:

or client can also call VicRoads via 13 11 72 or visit a VicRoads customer service building

—if vehicle is getting towed then an unregistered vehicle permit is not required—

4. FOR PURCHASER OF VEHICLE; To contact their relevant Government Road Authority and provide the above buyer’s/sellers receipt to legitimize vehicle sale which will be required 

 

Advertising costs:
Advertising costs consists of the sales platforms agreed to.
E.g. Facebook Market Place, Ebay, Car Sales, Gumtree etc.. These sales platforms incur an advertising cost that must be covered by the customer.

**If vehicle/s are advertised for more than 5 weeks, client can request that Don’s Advisory cease ‘selling on behalf of’ service within reason, and request 50% of the deposit back.

Worked example:
Deposit = $175
Refund = $87.50

–The market cannot be forecasted to determine an exact time and date of sale, Don’s Advisory will increase the likelihood for the vehicle to be sold as soon as possible but cannot guarantee a time line.

Cancellation:
Once this service is booked, no refunds will be payable unless Don’s Advisory is satisfied there are extenuating circumstances. 

The following is required for both Tier 1 and 2

Required Information:
For this service, it is required that the client sends photos of their vehicle within the following parameters clearly:
-Front
-Back
-Left side (full vehicle length)
-Right side (full vehicle length)
-Rear (full tailgate/boot showing bumper and tailpipe)
-Interior front
-Interior roof
-Sunroof (if fitted)
-Interior front floor (driver and passenger side)
-Interior rear (driver and passenger side)
-Centre console
-Dash (when vehicle is running); showing kilometres and engine codes (if any)
-Engine bay – showing full engine
-Tyres: all 4; clearly showing tread
-Rims/Alloys
-Tailgate/boot/trunk open;
-Imperfections or damage on exterior/interior of vehicle (paints, deformation, defects, dents)

Including a 2 minute video of their vehicle within the following criteria:
-Filming from initial startup with window open.
-Walking around the car in good light (can see colour and defects clearly)
-Filming all windows going down then up
-Filmed use of sunroof opening/closing, going up and down (if fitted)
-Filming glove box opening and closing
-Filming centre console lid opening/closing
-Inclusive of filming the engine run for 20 seconds

Additional information required:
-Airconditioning and Heater system runs and works (blows cold and hot)
-All head/taillights and brake lights work
-If and when the last timing chain/belt replacement was; with invoice or sticker on car sent
-Service history; will need to supply service history (photos or scanned documents)
&
If they are a smoker.

Once Don’s Advisory receives required information, within 72 hours, the client will be supplied the following:

-3 trade valuations from professionals within the automotive industry such as wholesalers for current market value
– List of suggestions on how to increase value at home e.g. aesthetic touch ups (paint or light defects)
-Heavy rectification suggestions including where to go with indicative costs
&
-List of FAQ’s on vehicle including vehicle type, variation, engine type, commonly asked question on particular vehicle, responses on commonly asked questions, strategies to avoid time wasters, and a list of the documents they will need to sell vehicle along with where to find them

**Don’s Advisory suggests that client visits a local/trusted mechanic to ensure vehicle will pass a RWC (Road Worthy Certificate) as that will be required for any privately sold vehicle to be sold with registration.
